Samir Modi's Rape FIR Quashing Plea: Delhi High Court Schedules Hearing for January 2026

Samir Modi was taken into custody on September 18 following his return from London.
The Delhi High Court has issued a notice regarding Samir Modi's petition to quash the FIR in an alleged rape case. The FIR was initially registered at the New Friends Colony Police Station. Modi was subsequently granted bail by the Saket District Court on September 25, following his arrest on September 18.
Justice Sanjeev Narula issued the notice to Delhi Police on Thursday, requesting their response. The court has scheduled the next hearing for January 12, 2026.
A petition has been filed on Samir Modi's behalf seeking to quash the FIR and all related proceedings in the case.
Senior advocates N Hariharan and Vikram Sharma, alongside advocate Siddharth Yadav, represented Samir Modi in court.
During the proceedings, Senior Advocate N Hariharan stated that the case is currently under investigation. He argued that the relationship between Modi and the complainant was entirely consensual, with multiple pieces of evidence available to substantiate this claim.
Hariharan further contended that the Investigating Officer was not taking these evidential matters into consideration.
After hearing these submissions, the bench issued a notice, which was accepted by Sanjay Lao, Standing counsel for the State.
Lao assured the court that the documents submitted by Modi would be properly examined by the Investigating Officer.
On October 15, the Delhi High Court had also issued a notice concerning a petition challenging the bail granted to Samir Modi in this case.
The complainant had approached the High Court seeking to overturn the trial court's decision to grant bail to Modi on September 25.
The Saket District Court had granted bail to the businessman on that date.
Modi was arrested on September 18 immediately upon his return from London.
Additional Sessions Judge (ASJ) Vipin Kharb granted bail to Samir Modi contingent upon furnishing a bail bond of Rs 5 lakh and one surety of the same amount.
Upon his return from London, Modi was detained at the Airport due to a Lookout Circular (LOC) and was subsequently handed over to police authorities on September 18.
