The Supreme Court on Tuesday denied bail to an individual charged under the Unlawful Activities (Prevention) Act (UAPA) in a terror-related case, just one day following a suicide bombing near Delhi's Red Fort.
Monday's explosion occurred in a car during rush hour near the historic Red Fort, resulting in at least nine fatalities and numerous injuries.
During Tuesday's proceedings, senior attorney Siddhartha Dave, representing the defendant, remarked, "It is not the best morning to argue this case after the events of yesterday."
In response, the bench comprising Justices Vikram Nath and Sandeep Mehta stated firmly, "This is the best morning to send a message."
When the court highlighted that inflammatory materials were discovered in the accused's possession, the defense counsel argued that only Islamic literature had been found.
Justice Mehta noted that the accused had created a WhatsApp group featuring a flag nearly identical to that of ISIS.
The defense attorney emphasized that his client had already spent over two years in detention, but the court referenced the grave nature of the allegations against the defendant.
Despite the lawyer's assertions that no RDX or explosive materials were recovered and that his client was 70 percent disabled, the Supreme Court refused to grant bail.
The court directed that the trial should be completed within two years. If this deadline is not met, the accused may submit a new bail application, provided that the trial delays are not attributable to the defendant.
