Delhi Court Orders Wife to Return Property to Evicted Husband Due to Lack of Ownership Evidence

A Delhi court has ruled that a woman must return property possession to her husband after evicting him during marital discord. District Judge Ankur Jain determined the woman failed to provide documentation proving her ownership claims, despite her assertions that she financially contributed to the purchase. The court found the property's 2007 sale deed was in the husband's name and had never been legally challenged.

Delhi Court Directs Woman Who Ousted Husband From Property To Return Possession

A Delhi court has ordered a woman to return possession of property to her husband after she evicted him due to marital discord. The court determined that the woman failed to provide documentation proving her ownership rights.

District Judge Ankur Jain presided over the case, examining the husband's petition for property recovery. The husband, represented by Advocate Manish Bhadauria, claimed his wife had forced him out of their property amid relationship troubles.

In the October 29 ruling, the court highlighted that the woman possessed no title documents demonstrating ownership rights to the property. The property's sale deed was registered in the husband's name, and the woman had never legally contested this 2007 document.

The court noted that the woman's only defense was her claim that the property was purchased using funds she received from her parents and relatives during their marriage. She also alleged selling valuable items, including gold ornaments, to finance the acquisition of several properties, including the disputed one.

"However, the defendant has not filed any supporting documents in this regard, nor mentioned any details as to how much the alleged gold ornaments were sold and what amount was given by her to the plaintiff for the purchase of the suit property, or how many properties were purchased from the money arranged by the defendant, as alleged," the court stated.

The judge characterized the woman's assertions regarding her property rights as "bald averments" without substantiation.

"Hence, in view of the above, this court holds that defendant cannot be said to have any rights in the suit property," Judge Jain concluded.

The court directed the woman to "hand over peaceful and vacant possession of the suit property" to her husband and prohibited her from creating any third-party interest in the property.
