Delhi Court Grants Bail to Samir Modi in Sexual Assault Case: Legal Proceedings and Conditions

A Delhi court has granted bail to businessman Samir Modi, cousin of Lalit Modi, in a rape case under specific conditions including a Rs 5 lakh bond. The complainant accuses Modi of repeated sexual assault, threats, and deception since 2019. Judge Vipin Kharb ruled that custodial interrogation was unnecessary as the case would be established when the complainant testifies in court.

A Delhi court on Thursday granted bail to Samir Modi, cousin of fugitive businessman Lalit Modi, who had been arrested in a rape case.

Additional Sessions Judge Vipin Kharb approved his release on a personal and surety bond of Rs 5 lakh each, along with specific conditions. These include restrictions against leaving the country, mandatory trial attendance, abstaining from criminal activities, and not interfering with evidence.

The judge stated, "The case of the prosecutrix that consent of the complainant for a sexual relationship was obtained as the accused was in a position of control or was having dominance over the complainant or on a false promise of marriage would be established once the prosecutrix steps into the witness box and leads evidence. However, no custodial interrogation is required for the said purpose."

According to the filed FIR, the complainant has accused Samir Modi of repeatedly raping her, making threats against her, and engaging in deceptive behavior since 2019.
