In the fatal BMW collision near Dhaula Kuan that resulted in the death of Navjot Singh, a Deputy Secretary in the Ministry of Finance, the accused, Gaganpreet Kaur, has applied for bail, emphasizing that the crash was "wholly accidental" and without intent.
Her legal representative pointed out that she is the mother of two young daughters, possesses no prior criminal record, and suffered a head injury herself during the incident.
Filed under Section 480 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the bail petition argues that there is no necessity for custodial questioning. It further states that Kaur has been fully cooperative with investigators, is well-established in society, and presents no flight risk or possibility of evidence tampering.
Duty Judicial Magistrate Akanksha Singh placed Kaur in two days' judicial custody on Monday after Delhi Police brought her to the judge's residence.
The court has issued notice regarding her bail application and scheduled it for hearing on September 17. Instructions were also given to jail authorities to provide appropriate medical attention for Kaur.
Senior Advocate Vikas Pahwa, together with Advocate Prabhav Ralli representing Kaur, challenged the police's request for remand, highlighting a 10-hour delay in FIR registration. Advocate Ishan Dewan appeared for the victims.
Police have charged Kaur under provisions related to culpable homicide not amounting to murder, among other sections.
According to the prosecution, Kaur's BMW hit a divider and overturned, creating a chain reaction where the victim's motorcycle collided with a DTC bus. Kaur, her family members, and the motorcyclists sustained injuries and were hospitalized before her arrest on September 15. She will remain in judicial custody until her bail hearing on September 17.
