Process Begins for Justice Surya Kant's Appointment as Next Chief Justice of India Following BR Gavai's Retirement

Justice Surya Kant, the seniormost judge following the Chief Justice of India, is positioned to become the next head of the Indian judiciary.
On Thursday, the government commenced the process for appointing the successor to Chief Justice B R Gavai, who will conclude his term on November 23, according to sources.
The formal letter requesting Justice Gavai to nominate his successor is expected to be delivered either Thursday evening or Friday, informed individuals familiar with the judicial appointment procedures told PTI.
As per the memorandum of procedure governing the appointment, transfer, and elevation of Supreme Court and High Court judges, the position of Chief Justice of India should be filled by the seniormost Supreme Court judge deemed suitable for the role.
The Union Law Minister is responsible for seeking the outgoing Chief Justice's recommendation for succession "at the appropriate time."
Traditionally, this formal request is issued one month before the current CJI reaches retirement age of 65 years.
Justice Surya Kant currently stands as the seniormost judge after the CJI, making him the anticipated successor to lead the Indian judiciary.
Upon appointment, Justice Surya Kant will assume the position of CJI on November 24 and is expected to serve for approximately 15 months, until February 9, 2027.
