Mumbai Terror Suspects Seek Discharge Citing Lack of Evidence in Pakistan-Linked Module Case

Two Mumbai residents, a teacher and a tailor charged in a Pakistan-supported terror module case, have sought discharge from court claiming prosecutors have failed to demonstrate any actual terrorist acts or conspiracy despite completing investigations. The case involves allegations of harboring the primary suspect Zakir Husain, who allegedly had connections with operatives in Pakistan. The court has scheduled the next hearing for December 10, with the accused currently out on bail.

Two Mumbai residents implicated in a Pakistan-supported terror module case filed for discharge on Saturday, arguing that prosecutors have failed to demonstrate "a single instance of preparation, conspiracy or actual act of terror".

Rizwan Momin, a teacher, and Irfan Shaikh, a tailor, face charges of sheltering and harboring the primary suspect, Zakir Husain, who was apprehended by Maharashtra Anti-Terrorism Squad (ATS) in September 2021. Their arrests followed Husain's interrogation.

According to prosecutors, Zakir Husain maintained continuous communication with his brother Sagir in Pakistan, leading authorities to believe Sagir was orchestrating some malicious plan.

The prosecution has stated that following his arrest, Husain provided a statement indicating he had been assigned "big work" at the direction of "Chota Shakil through Sagir".

The ATS contends that Momim and Shaikh assisted Husain in terrorist activities, including providing accommodation at their residences.

Furthermore, prosecutors claim Momim destroyed Husain's mobile phone and SIM card following the suspect's instructions.

In their discharge petition filed before the court through advocate Rohin Chauhan, the two accused maintain that the evidence against them is "extremely weak".

Their plea argues that no prima facie case demonstrates their involvement in the alleged offenses.

While prosecutors claim the duo aided Husain in terror activities, the defense contends that even after concluding investigations, authorities have failed to identify a single instance of preparation, conspiracy, or actual terrorist act, according to the petition.

The court has requested the prosecution's response to the discharge plea. The next hearing is scheduled for December 10.

While Hussain remains in judicial custody, the other two accused have been released on bail.
